Please read these terms carefully before using Spark products or services.
Acceptance of Terms
By joining the Spark waitlist, purchasing a Spark device, or using any Spark software or services, you agree to these Terms of Service. If you do not agree, please do not use our products or services. These terms apply to all users globally unless local law provides otherwise.
Waitlist & Pre-Orders
Joining the waitlist is free and non-binding. No payment is collected at sign-up. Early-bird pricing ($299) is reserved for waitlist members and is subject to availability. We reserve the right to adjust pricing before units ship. You will be notified before any payment is collected.
Use of Spark Hardware & Software
Spark hardware and software are licensed, not sold, for personal or professional use on your premises. You may not reverse-engineer, disassemble, or redistribute Spark software. Modification of hardware that voids safety certifications is done at your own risk. We provide software updates automatically; certain updates may be required for continued app integrations.
App Integrations & Third-Party Services
Spark connects to third-party services (Google, Slack, Notion, etc.) under their own terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services. You are responsible for ensuring your use of connected services complies with those services' terms.
Privacy
Your use of Spark is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Camera and audio data is processed on-device and not uploaded to our servers unless you explicitly share a recording or enable a cloud feature.
Limitation of Liability
To the maximum extent permitted by law, Creston & Company is not liable for indirect, incidental, or consequential damages arising from your use of our products. Our total liability to you for any claim will not exceed the amount you paid for the product in question.
Warranty
Spark hardware carries a 12-month limited warranty against manufacturing defects from the date of delivery. This does not cover accidental damage, misuse, or unauthorised modifications. Software is provided "as is" without warranty of uninterrupted or error-free operation.
Governing Law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any disputes will be resolved through binding arbitration under the AAA Commercial Arbitration Rules, except where prohibited by local law.
Changes to Terms
We may update these Terms as our product evolves. We will notify you by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance of the updated Terms.
